These terms govern the use of SwiftForm ("SwiftForm", "we", "us"), a WhatsApp-based booking and job-management platform for small service businesses. By creating a SwiftForm account or using the service, you ("you", the "business") agree to these terms. If you are accepting on behalf of a business, you confirm you are authorised to bind it.
Our Privacy Policy explains how we handle personal information and forms part of these terms.
1. The service
SwiftForm connects a business's WhatsApp Business Account to our platform so that customer messages can be answered automatically, bookings can be taken through WhatsApp, and the resulting jobs can be managed in a web dashboard. Features include automated replies and menus, booking flows, appointment reminders, message templates, customer records and job cards.
SwiftForm is built on Meta's WhatsApp Business Platform. We are an independent technology provider and are not affiliated with, endorsed by, or acting on behalf of Meta or WhatsApp.
2. Accounts
- You must provide accurate account and business information and keep it current.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- One account represents one business. You may not share an account across unrelated businesses.
- You must be at least 18 years old and legally able to enter into a contract.
3. Your WhatsApp connection
To use SwiftForm you connect a WhatsApp Business Account through Meta's Embedded Signup. In doing so you:
- Grant SwiftForm permission to manage that WhatsApp Business Account and to send and receive messages on its behalf, solely to provide the service to you.
- Confirm that you own or are authorised to use the phone number you connect.
- Agree to Meta's WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the applicable Meta Commercial Terms, which apply in addition to these terms.
Meta determines phone-number eligibility, messaging limits, quality ratings, template approvals and account restrictions. SwiftForm cannot override Meta's decisions, and we are not responsible for restrictions Meta applies to your account.
4. Acceptable use
You agree not to use SwiftForm to:
- Send messages to people who have not agreed to hear from your business, or continue messaging anyone who has asked you to stop.
- Send spam, bulk unsolicited marketing, misleading content, or anything that breaches WhatsApp's Business Messaging Policy or applicable law, including South Africa's Consumer Protection Act and POPIA.
- Impersonate another business or person, or misrepresent what your business does.
- Interfere with the service, probe its security, or access other businesses' data.
- Resell or sublicense the service without our written agreement.
SwiftForm's automation is configured to represent your business for bookings and customer enquiries. It may not be presented to customers as a general-purpose assistant or chatbot unrelated to your business.
We may suspend or restrict an account that, in our reasonable view, breaches this section, harms other users, or puts our relationship with Meta at risk. Where practical we will notify you and give you a chance to put things right.
5. Fees and billing
- SwiftForm is offered as a recurring subscription. Prices, billing frequency and any free-trial terms are shown at sign-up and in your account settings.
- Payments are processed by our payment provider. We do not store your card details.
- Subscriptions renew automatically until cancelled. You can cancel at any time from your account; the cancellation takes effect at the end of the current billing period and fees already paid are not refunded unless the law requires it.
- Meta may charge separately for certain WhatsApp messages (for example, business-initiated template messages). Those charges are set by Meta and are your responsibility where they apply.
- We may change prices with at least 30 days' notice by email. Continued use after the change takes effect means you accept the new price.
- If a payment fails, we may suspend the service until the balance is settled.
6. Your data and your customers' data
- You own the content and data you and your customers submit through the service. You grant us the rights needed to host, process and transmit it to provide the service.
- For your customers' conversations and booking details, you are the responsible party under POPIA and SwiftForm acts as your operator, processing that data on your instructions and keeping it confidential and secure.
- You are responsible for having a lawful basis to collect and use your customers' information, for responding to their requests about their data, and for honouring opt-outs.
- You can export your data from the dashboard, and you may request deletion of your account and its data as described in our data deletion instructions.
7. Availability and changes
We aim to keep SwiftForm available and reliable, but the service depends on third parties — including Meta's WhatsApp platform, hosting providers, payment providers and mobile networks — that we do not control. We do not guarantee uninterrupted or error-free operation. We may change, add or remove features, and will give reasonable notice of changes that materially reduce the service.
8. Intellectual property
SwiftForm and its software, design and content are owned by us or our licensors. These terms give you a limited, non-exclusive, non-transferable licence to use the service for your business while your account is active. Feedback you give us may be used to improve the service without obligation to you.
9. Disclaimer and limitation of liability
The service is provided "as is" and "as available". To the extent permitted by law, we exclude all implied warranties, including fitness for a particular purpose.
To the extent permitted by law, SwiftForm is not liable for indirect, consequential or special loss, loss of profit, loss of business, or loss of data, and our total liability for any claim arising from the service is limited to the subscription fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act where it applies to you.
10. Termination
- You may close your account at any time.
- We may suspend or terminate an account for material breach of these terms, for non-payment, if required by law or by Meta, or if we discontinue the service (with at least 30 days' notice in that case).
- On termination we disconnect your WhatsApp Business Account from SwiftForm. Your WhatsApp Business Account itself remains with Meta and under your control. We delete or anonymise your data as set out in our Privacy Policy, subject to legal retention requirements.
11. General
- These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
- If any part of these terms is found unenforceable, the rest continues to apply.
- We may update these terms from time to time. We will post the new version here with an updated date and, for material changes, notify you by email at least 14 days before they take effect. Continued use after that date means you accept the updated terms.
- These terms, together with the Privacy Policy, are the whole agreement between you and SwiftForm about the service.
